The Backburner.NET provides Hosting as a service to the Gaming Community. Hosting at The Backburner.NET is free, but it does have its rules and limitations. Please review the rules below, carefully. If there are any questions please feel free to contact us.
1) The Backburner.NET will not be held responsible for any content available on any of the hosted sites. This includes, but is not limited to data, text, software, music, sound, photographs, graphics, video, messages or other materials, whether publicly posted or privately transmitted. You agree to accept full responsibility for all content within your site. This means that you, and not The Backburner.NET are entirely responsible for all content that you upload, post or otherwise transmit via the Service.
2) By Using this service, you agree not to:
upload, post or otherwise transmit any content that is unlawful, harmful, threatening, defamatory, vulgar, obscene, hateful, or racially, ethnically or otherwise objectionable;
harm minors in any way;
upload, post or otherwise transmit any unsolicited or unauthorized advertising, promotional materials, "junk mail," "spam," "chain letters," "pyramid schemes," or any other form of solicitation, except in those areas of the service that are designated for such purpose;
use your home page (or directory) as storage for remote loading or as a door or signpost to another home page, whether inside or beyond The Backburner.NET;
Post images or text of a pornographic nature on The Backburner.NET for any reason whatsoever. Judgement on whether materials are of a pornographic nature is up to The Backburner.Net staff;
4) You agree to indemnify and hold The Backburner.NET and its subsidiaries, affiliates, officers, agents, co-branders or other partners, and employees, harmless from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of your Content, your use of the service, your connection to the service, your violation of the Terms of Service, or your violation of any rights of another.
5) The Backburner.NET the right at any time and from time to time to modify or discontinue, temporarily or permanently, the service (or any part thereof) with or without notice. You agree that The Backburner.NET shall not be liable to you or to any third party for any modification, suspension or discontinuance of the Service.
6) The Backburner.NET runs advertisements and promotions on The Backburner.NET Sites. By creating your The Backburner.NET Site, you agree that The Backburner.NET has the right to run such advertisements and promotions. The manner, mode and extent of advertising by The Backburner.NET on your The Backburner.NET Site is subject to change.
7) You agree that The Backburner.NET in its sole discretion, may terminate your password, The Backburner.NET Site, use of the Service or use of any other The Backburner.NET service, and remove and discard any Content within the Service, for any reason, including, without limitation, for lack of use or if The Backburner.NET believes that you have violated or acted inconsistently with the Terms of Service. The Backburner.NET may also in its sole discretion and at any time discontinue providing the Service, or any part thereof, with or without notice. You agree that any termination of your access to the Service under any provision of this Terms of Service may be effected without prior notice, and acknowledge and agree that The Backburner.NET may immediately deactivate or delete your The Backburner.NET Site and all related information and files in your The Backburner.NET Site and/or bar any further access to such files or the Service. Further, you agree that The Backburner.NET shall not be liable to you or any third-party for any termination of your access to the Service.
8) If any illegal content is found in your hosting space. YOU WILL BE HELD RESPONSIBLE ON HOW IT GOT THERE! We will give your information to the authorities with a complete log of your activity on the site: including but which is not limited to, Bandwidth reports, Time and day you logged into our FTP service, The people's IP addresses on who viewed your website, and a complete downloaded version of your site when we found the illegal material.
9) No files over 20 Megabytes (20,000,000 Bytes) can be uploaded to The Backburner.NET servers at any time. Doing this will result in deletion of your account.
10) It is mandatory that the banner ad code of The Backburner.NET must be on ALL WEBPAGES. Failure to do so will resort in deletion of your account.
